01

Agreement and scope

These Terms of Use (“Terms”) govern access to websites, demonstrations, accounts, and services made available by CROW FINANCIAL HOLDINGS LLC DBA CURA COACH (“CuraCoach,” “we,” “us,” or “our”). By accessing or using them, you agree to these Terms.

If your organization has a signed service agreement with CuraCoach, that agreement controls where it conflicts with these public Terms. Business associate agreements, data-processing terms, ordering documents, and customer policies may also apply. If you do not agree, do not use the applicable service.

02

Eligibility and authority

You must be legally capable of accepting these Terms and authorized to act for any organization you represent. CuraCoach services are intended for authorized healthcare, operational, billing, and business users—not independent use by patients or children unless CuraCoach expressly launches and authorizes a patient-facing service.

03

Accounts and access

You must provide accurate registration information, keep credentials confidential, use an individual account, complete required authentication, and promptly report suspected compromise. You are responsible for activity performed through your account to the extent permitted by law.

Access is limited by organization, practice, site, role, capability, assignment, and purpose. CuraCoach may suspend or revoke access to protect patients, customers, CuraCoach, or the service; investigate misuse; comply with law; or enforce an agreement.

04

Acceptable use

You may not access information outside your authorized scope; share accounts; bypass security controls; probe or disrupt the service; introduce malware; scrape or bulk-extract data without authorization; reverse engineer except where law prohibits restriction; submit unlawful or misleading material; impersonate another person; forge device, clinical, billing, or payment information; or use CuraCoach to violate privacy, communications, healthcare, export, or other applicable laws.

Security research requires prior written authorization and an agreed scope. Automated use must occur through documented, authorized interfaces and credentials.

05

Clinical use and emergencies

CuraCoach is an operations and connected-care technology platform. It does not replace a qualified healthcare professional, establish a clinician-patient relationship, independently diagnose a condition, prescribe treatment, or provide emergency services. Clinical alerts, configured ranges, summaries, transcripts, and AI-assisted drafts require review under the customer’s clinical policies.

Do not use CuraCoach as the sole method to seek emergency assistance. In an emergency, contact the appropriate local emergency service. Customers are responsible for clinical coverage, escalation protocols, and communicating limitations to their workforce and patients.

06

Billing and reimbursement information

Billing readiness, suggested codes, time calculations, revenue estimates, and rule evaluations are operational decision support. They are not legal or coding advice and do not guarantee coverage, claim acceptance, reimbursement, payment timing, or any particular financial result. Final code selection, claim submission, documentation sufficiency, and payer compliance remain subject to qualified human review and applicable agreements.

07

Customer data and confidentiality

Customers retain their rights in data they lawfully provide. They are responsible for having authority to submit it, configuring authorized users, and using CuraCoach consistently with applicable law and agreements. CuraCoach may process customer data to provide, secure, support, and improve the contracted service as allowed by the applicable agreement.

PHI is subject to the applicable business associate agreement when required. Public forms must not be used to transmit PHI, payment-card data, credentials, or other sensitive records.

08

CuraCoach technology and feedback

CuraCoach and its licensors retain all rights in the service, software, interfaces, documentation, designs, trademarks, and related technology, excluding customer data. Subject to these Terms and any service agreement, CuraCoach grants authorized users a limited, revocable, nonexclusive, nontransferable right to use the service for its intended business purpose.

If you provide feedback, you permit CuraCoach to use it without restriction or compensation, provided CuraCoach does not identify you or disclose protected information contrary to an applicable agreement.

09

Third-party services and integrations

CuraCoach may connect with device vendors, EHRs, communication providers, billing partners, payment providers, shipping systems, and other services. Their availability, terms, data practices, and performance may be outside CuraCoach’s control. An integration shown in demonstration or mock mode must not be understood as a production connection, endorsement, or guarantee of continued availability.

10

Disclaimers and service changes

To the fullest extent permitted by law, public website and demonstration materials are provided “as is” and “as available.” Demonstration names, readings, practices, claims, and financial amounts are synthetic. CuraCoach does not warrant that public materials are error-free, continuously available, or suitable for a specific clinical, billing, regulatory, or operational purpose.

Production warranties, service levels, support obligations, remedies, limitations of liability, indemnities, governing law, and dispute terms are established in the applicable signed agreement. Nothing in these Terms excludes a right or responsibility that cannot lawfully be excluded.

11

Suspension, termination, and changes

You may stop using the public website at any time. Account termination, data return, retention, transition assistance, and fees are governed by the applicable service agreement. Provisions that by their nature should survive—including confidentiality, ownership, record integrity, disclaimers, and accrued obligations—continue as applicable.

We may revise these Terms by posting an updated effective date. Material changes may receive additional notice when appropriate. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.

12

Contact

Questions about these Terms may be submitted through the CuraCoach contact page and labeled “Legal.” Do not include patient information or other sensitive data in the public form.
